Huang Hui participates in the Supreme People’s Court research on modifications to the Special Maritime Procedure Law

On 28 October 2019, Guangzhou International Maritime Justice Research Base of the Supreme People’s Court carried out its research project on modifications to the Special Maritime Procedure Law in southern China by a seminar held at Guangzhou Maritime Court. In attendance were the project team of the Supreme People’s Court, maritime judges from the higher courts of Guangdong Province, Fujian Province, Guangxi Province and Hainan Province, senior judges from Guangzhou Maritime Court, Xiamen Maritime Court, Beihai Maritime Court and Haikou Maritime Court, as well as more than 40 invited experts, scholars and maritime law practitioners in southern China. The seminar was chaired by Song Weili, chief of the Enforcement Division of Guangzhou Maritime Court.


Modification proposals made by participants focused on the scope of application of the Special Maritime Procedure Law, the scope of accepting cases by maritime courts, jurisdiction, preservation of maritime claims, maritime injunction, evidence preservation, security, service of legal documents, and procedures for trial, constitution of limitation fund for maritime claims, claims registration and ranking, notice of maritime liens and maritime enforcement.


With nearly 20 years dedicated to the practice of maritime law, our partner Mr. Huang Hui attended the seminar on invitation. In his speech, Mr. Huang proposed that establishment of an independent maritime-related legal system has become a practical development trend and elaborated the necessity to incorporate maritime criminal cases and maritime administrative cases into the jurisdiction of maritime courts. Besides, he also put forward good proposals to tackle practical issues in relation to notarization and legalization of evidence materials and authorization documents.
