In July of 2002, Vessel A carrying more than 28000 tons of electrolytic copper imported by a metals company from Spain and Holland arrived at Huangpu Port of China and discharged the cargo there. A shortlanding of 39 bundles and short weight of 110.901tons of copper in total were found. The ship was arrested by Guangzhou Maritime Court after the cargo receiver’s application and the owner provided USD 300,000 as guarantee. After compensating the consignee, a famous national Insurance Company brought recourse claim by the right of subrogation against the carrier. By successfully applying delicate legal techniques, the client was discharged from compensation liability despite of nearly unchallengeable facts. The plaintiff did not appeal of the case after the first instance court’s judgment was issued. |
