Antedated B/L

A vessel owned by “A” Company carried a parcel of steel cargo imported by “B” Company from Ban Sha Fan Port of Thailand to Huangpu Port of China in March 2003. “B” Company brought an action with Guangzhou Maritime Court against “A” Company and a Korean shipping company, claiming that the B/L was ante-dated and seeking damages for economic losses in the amount of US$2 million. Our Mr. Huang Yaquan handled this case for and on behalf of “A” Company and the vessel’s P & I club. Guangzhou Maritime Court found “A” Company not liable and ordered the Korean shipping company to pay US$ 190, 000.00 to the plaintiff.

“B” Company and the Korean shipping company both appealed to Guangdong Provincial High People’s Court in February 2005. The high court accepted our lawyer’s submissions and handed down a final judgment to uphold the first instance judgment made by Guangzhou Maritime Court. This is to say, no liability was found on the part of our client “A” Company.
