On 14th November 2004, “Rithi Bhum” collided with “Eastern Challenger” in the vicinity of Shantou waters, causing “Rithi Bhum” damaged, “Eastern Challenger” sunken, and the fuel oil on board “Eastern Challenger” leaked which led to pollution of the waters.
Concerning the cleaning-up expenses, Shantou MSA, on behalf of all parties that took part in oil pollution removal, together with Guangdong Provincial Oceanic and Fishery Bureau who concerned the loss of ecological resources caused by the oil pollution, instituted claims up to RMB 33 million against the ship owners of “Rithi Bhum” and “Eastern Challenger” and their respective P & I Club. Mr. Huang Yaquan & Mr. Huang Hui acted in this case on behalf of the ship owner of “Rithi Bhum” and the ship’s P & I Club. After several rounds of negotiation and with the unremitting efforts by lawyers of Huang & Huang Co. Law Firm, this case was closed with amicable settlement. The ship owner of “Rithi Bhum” and its P&I Club shall compensate CNY 3.25 million to all the cleaning-up units represented by Shantou MSA and CNY 2.25 million to Guangdong Provincial Oceanic and Fishery Bureau as the full and final settlement of the claims.
